It pretty shitty, that they add the tax on the price.
The prices should be adjusted for every region, so that price + tax add up to the same sum, like in German fast food chains.
(Depending on if you eat at the restaurant(using a gastronomic service) or take the meal home(buying food), the tax is different, but you still always pay the same price.)

The eShop shouldn't have to charge tax, for most states at least.

In most states, since Nintendo does not have their own physical stores, the purchase would be considered to be the same as mail order, so no sales tax needs to be collected.

Online sites that also have physical stores, such as Game Stop, have to charge you sales tax for Internet orders.
