It is quite probably ported and recompiled, after all Nintendo has the source code.

If that is the case, then sure they could be running them on Dolphin in the remote server, I don't think there is any law that prevents that given the GPLv2+ license. Only if they happen to make some change to the emulator source code, they should publish those changes, but who says changes need to be made?
