That is correct, you need an emunand for your CFW/Homebrew stuffs, and a sysnand for your online stuffs.
What kind of question is this? There has never been a 'legal modchip'. Depending on country they are either in a grey zone or forbidden. Per definition it is impossible to create such a thing whose only reason for its existance is to circumvent copy protection/security mechanisms.

Nintendo can come out with one to compete with AliExpress. That would make it legal, I guess. They also have the "virtual" version of this modchip, which costs several $$$$$$K up-front, then you can play any game you like. The virtual version will include a Raspberry Pi4 for homebrew.
Console modifications are already illegal, even more when the objective of said modifications is allowing piracy.

Eventhough the New 3DS XL is more powerful, I still feel like the DS Lite was a more polished system. It's a real shame that it never got an XL variant keeping the GBA slot. You'd have to go on AliExpress and buy an ML shell to give a DS phat the unofficial "DS Lite" treatment, and that's the best we'll ever get I'm afraid.+1 -
