No, not necessarily. You can use public headers to make your roms work online. HOWEVER, every header contains a unique ID, which MAY or MAY NOT be tracked by nintendo (which may or may not be used to ban you from online at a later date)

The purpose of using a retail dump of your own is so you can get a unique ID of your own. So others won't go online with it at the same time as you. Thus maybe hopefully avoid a possible future ban.

Can anyone help me test AC online? Tried it with someone just now and I can open my gate. However, when they tried connecting it stays on saving screen for awhile then shows the "An error has occurred" screen.
I'm sitting next to my router too, so connection strength shouldn't be a problem.

Since not much is known on what information is transferred to Nintendo during online play, it's hard to say.

They could just end up whitelisting all key+game combinations and stop the other options. I'd be surprised if the lists of produced carts weren't available to Nintendo

Still no luck with Mario golf after trying everything.I have question please: I succeeded to make Mario tennis open usa to work online , the problem is I didn't succeed in finding any one to play with me ..the searching keeps on and on with nothing.So I wonder is their problem with the rom itself or there is no body playing mario tennis now adays

from the carts i dumped, the value "00" was more often seen in older games and "02" in more recent ones. But it's not a huge help.
Into the Kirin nfos you can also see the chip id and save type values if interested.
