If I was on a brand new 3ds console, could I sign into a Nintedo Network Id without updating?

You have to call Nintendo to have them move the old NNID from your old device to your new one, there is no way to just log into one.
(Unless it's from one existing on a Wii U being logged into on a 3DS and vice versa.)
