Ok, I loaded my NAND backup, and now I'm back on stock, and I totally freaked out when I saw an error message appear when I opened friend list.
It was just a prompt telling me to update to use it, and when I did, it let me use it haha.

So you're unbanned by restoring a stock FW NAND?

Still not banned, tested right now with Monster Hunter and Mario Kart 7. Downloaded some stuff from Freeshop yesterday but no ban. Gonna keep an eye during the weekend.

I've noticed that I had never opened the activity log. My activity log didn't have any cfw softwares in it. When I opened the log, a message with "you have played new softwares!" appeared and they were inserted. After closing the activity log, the console was SAVING the newly registered games. When I opened the log again, they were there. No way to delete that data, or the log app. I'd put my money on that.

Good, just tested. 2 consoles, NOT banned! And restarted for several times and keep running staying on Friend List to make sure of it.
All settings like SpotPass, Friend List title showing, Activity Log were set to off or cleaned just yesterday. And the day before yesterday, in the night, I used FBI to install DLCs for both consoles with all settings to default (ON), I clearly remember that, the friend list title showed FBI and Quick Shutdown in each other.
One is US, the other is Ja changed to US.
Both with B9S and Luma 7.1 the latest compiled, using RedNAND, not SysNAND.
I think I could make a vote.
@Aurora Wright , need more information?

I'll keep an eye on the two.

Don't worry about the Activity Log specifically. It is populated with information stored in PTM and will always come back unless PTM itself is cleared which I have never done specifically, so maybe someone else can enlighten us how.

Just voted myself, have the option enabled, been checking since I logged in today and have not yet been banned (both consoles are in sleep mode atm on their chargers). Both devices are running the latest Nintendo FW and are running the latest version of Luma on Boot9Strap and have the same exact configuration. SpotPass is on, with sending information to Nintendo enabled.

I'm afraid they are finally getting around to checking their id logs for online play against purchase lists.

If you play online with something you have not purchased, they CAN detect it.

i've known how it could be done in theory for quite a while. everytime you play online with a cart, the cart's id is sent to nintendo.
every time you play online with a cia, your console id is sent to nintendo.

they can trivially log this info, and check it. before they were only checking simultaneous login from same cart id. this is how they were catching .3ds users.

If it turns out they ARE logging, and not just checking for simultaneous login, we simply have to accept that you must use nothing but legit cias (that are bundled with systems) or risk a ban wave.

Assuming they are detecting freeshopping and downloaded CIAs of their software, they are within their rights to ban.

I can go into the online battle mode and don't get any error code, but there is no one online atm so I can't check if I can actually play. Does it already mean I'm not banned?

If you still have access to eShop, download Team Kirby Clash Deluxe. There's a button called "Wandering Adventurers". If you are banned, it'll show you 002-0102 error. If not banned, it'll find some other player online and give you some apples and gems. I'm not sure if you have to unlock the feature by playing the game or not.

I also have friends with environment almost the same as yours, that aren't banned too.

So, NNID-less, Mii-less, SpotPass sharing settings OFF seems like a ban free.
They did not enter eshop too. All have installed CIAs both games and homebrew.

I think the game matters. Nintendo games won't work, but I heard ATLAS and other games work.

That does sound pretty plausible, and it might be why some people with CFW are getting banned and others are not. I don't think I've ever played online multiplayer with any .CIA files, either, and that's why I haven't been hit with any banhammer yet. It would also make a lot of sense.

I'm touching wood, i'm not banned yet + my NNID is "flushed", cannot use the eShop...
For some french people it was B9S that made them banned.

+ I have a B9S Old 3DS XL on 14.1 EUR with Luma 7.1.

Do you think that's because the fact that Nintendo can see the signatures that have been changed ? (the basic thing about sighax.)

*nvm found the solution about my NNID on nintendo's support :*
  1. If the issue persists for more than 24 hours, go to the system's HOME menu. Select “System Settings,” then select “Nintendo Network ID Settings.”
  2. Select “Sign In.” Enter the password associated to the Nintendo Network ID, then “Confirm.”
  3. The error message (“You cannot use this Nintendo Network ID on this console”) will appear on the screen.
  4. While the error message is onscreen, hold down the X button AND Y button, and tap “OK.”
  5. Select “Yes” to unlink the Nintendo Network ID from the system.
  6. You will receive a message that the NNID link has been removed. Tap “OK” to return to the system settings.
  7. You can now re-link the Nintendo Network ID to the system, which should resolve the issue. How to
    • Purchases associated to the system / NNID will still be available for re-download.

Also, there are physical versions, and those aren't really linked to the eShop.
