However if you was caught doing switcheroo after the transaction, you are to face legal action as Gamestop operates with pawnshop regulation that they would have to report (archive) thing like serial number about thing they take in from people. So if the strange serial number somehow become a problem down the road for Gamestop/pawnshop, they would trace it and turn you in to the law enforcement to deal with you.Well even if you did get caught I am sure you could just act like you made a "honest" mistake, and they would let it slip through or just cancel the return.
So the risk is always there doing this kind of thing and the sentence for such crime if you get caught is not worth it.

How considerate of NintendoApparently if it sends a system update it will say "sending system update" or words to that effect and you'll have an opportunity to cancel.
