given all these polls on here dont take in account to those with multiple systems im not gonna be doing anymore ..

my O2ds had it on and was not banned as of right now still not banned but I shut down wifi just in case
my O3ds xl had it off and is banned

The culprits are most likely any homebrews installed as CIA (or any title with a non legit title id)

I think so as well. Most of us have HBL or FBI installed. So it's inevitable.

Homebrew can be deleted in system settings and you can remove games from the software library portion of Activity Log without needing homebrew.

Nope, just system settings.

That however doesn't remove the ticket tracks after the program. That's why FBI would been a better way to remove them. However, if they already checked you (probably). And we still don't know what they seen or how. For all we know, they might just have the 3DS call home at random intervals without us knowing.

I just changed my vote @Aurora Wright . I had indeed the spotpass on. Probably after the FW update it just turned on.

Nope, just system settings.

Unfortunately, you can delete homebrew info from Software Library, but it's still in Daily Records view as list.

It seems they get the title IDs of the things you launched, via spotpass. This makes it very easy to ban. They could either
1) compare the title ids with the bought ones (assuming they are able to tell if a title id belongs to a cart or not, and they probably can't)
2) have a whitelist. If any title ID isn't among officially released game/apps, in the whole world or in your region, obviously you modded the console
3) have a blacklist and check for specific titles (FBI, freeshop, etc.)
They also get the title ID of everything you launch if you enabled the "share currently played title" in the friends list. Which makes it also very likely

I'd exclude number 2, as the only title I've been playing since March is Monster Hunter XX (released only in Japan) on my EUR console, and I haven't been banned. But who knows, I'll probably get fucked in the ass tomorrow, or the day after ¯\_(ツ)_/¯

I've got 5 3DS's. None of them are banned. I played Mario Kart 7 online on all of them to make sure.

All of them have B9S with the latest Luma and they're on 11.4

They all have freeshop.

They all had "Send system information via SpotPass" ENABLED and it's always been enabled.

I have used PKSM to level up Pokemon on 3 of them.

It might be worth mentioning that I do not use the homebrew launcher. I might have used it at some point in the past, but I have not touched it on any 3DS for a very long time.

Hopefully this info is a little useful. I'll post again if any of them get banned.

I own all the cartridges, but I only use cartridges to transfer saves between systems with JKSM. I have the CIA's from freeshop installed on all of them.

I don't think it's that.

Could it be that Nintendo can see people using FBI since you can see that you currently have it open in the Friends List?

My MH4U N3DS XL was hit during the SuMo banwave but I unbanned it using my 2DS (which is now banned). My Galaxy N3DS XL (main system) seems to be fine at the moment. All three are on B9S and I have stayed away from FreeShop on my main system.
