Tell me about it. My N3DS LL is 8.1, while a JPN copy of Cubic Ninja is on its way here it's still impossible to use Ninjahax on that Firmware. If I had a NAND mod I could at least upgrade to 9.5 and downgrade later.
i would assume that there is no protection at all, but sure i guess it is technically possible.
Due to emunand support for the n3ds not including 9.5 ulon release this method will be good for those who kept their old 3ds and a copy of 9.4 emunand and want to update the n3ds emunand (the other option will be updating to 9.2 with a newer smash bros cartridge)

I just tried to update 4.5 sysnand to 9.2 via Second 3ds Emunand on 9.2. I started Mariokart installed as cia in local multiplayer Mode and connected the 4.5 via downloadplay. It told me i had to update to 9.2 first and i clicked ok. Then another window came up saying to consult the manual on how to Upgrade. Thats it. Nothing Else happened

So at the end it is not possible and you should update via the normal process. That means, in order to play a Download play title, you have to update both consoles to match their firmware?
Download play from a rom, not a cia, and it won't prompt to update. That or have the host on an older firmware.

@Xdqwerty there is health behaviour you can add to your character, then to use a health bar is lil more complicated, google n watch a few tutorial video on it, be too hard to explain here. -

I know you have to create a health and health max variable. Then there is a calculation you use in code to subtract width size of the health bar. Google few vids.
