Actually if the 3DS is only semi-bricked (can boot into recovery; but can't recover) I guess we could redirect it (Router-wise) to a custom website with a custom firmware; and because SigHax should sign the update (the way Nintendo does/with the same key Nintendo does?) and the 3DS will update as usually
