The ban wave is over, and there is pretty much no single common trait of the consoles that were banned. However, what we do know is that when you are online your currently playing title is sent to Nintendo, all the time, and logged on their servers, regardless of whether you disable SpotPass or displaying your currently playing title to friends. There is actually not a whole lot of information sent to Nintendo that is common across all CFW users that can be used to distinguish CFW users from legit users, but the one thing that is common across pretty much all of them is that they all had FBI installed and used it, and many of them had Luma Updater as well. As far as we know this is the single universally identifying factor for CFW users and other than that, there weren't really any common traits among CFW consoles, that's why people are avoiding CIA homebrew now. We don't know what's causing bans. At the same time, we don't know what's not causing bans. But what we know are that there are only a few possible things that could be used by Nintendo to identify CFW users and this is the only one of them that is almost universally identifying. It's of course possible that the reason there isn't really a clear identifying pattern besides this is because they use many different things to identify CFW users, or a combination of things. Anyway, bottom line is, I suggest you do your research before posting a thread like this and misleading users into thinking it's safe when there are signs pointing to the opposite. We don't know anything for sure yet, but telling people it's safe when you don't know is as bad as scaremongering them into thinking it's unsafe.
I have had cherry "pizza" before basically just a pizza crust with cherry pie filling poured on it and a frosting drizzled on top. Delicious but I would hardly call it a pizza.
