I can't use the Homebrew Launcher (or most of the software that you get with luma, like the universal updater) because of the parental controls from when we bought this 3DS XL used, and we don't know the pin; someone even gave me a 3dsx file that can remove it, but surprise surprise, can't use...- violent_froggy00

@BakerMan - you can still "own" digital media, arguably easier and better than physical since you can make copies and backups, as much as you like.+1
The issue is DRM -

You can buy drm free games / music / ebooks, and if you keep backups of your data (like documents and family photos etc), then you shouldn't lose the game. but with a disk, your toddler could put it in the toaster and there goes your $60
