    I too got an email from Nintendo for playing Zelda. Funny thing is I updated a bunch of other games too but Zelda was the only one which I played and the only email I got. So I'm pretty sure Nintendo kept track that Zelda was played and the rest weren't even launched. FWIW I'm still not banned.

    I've done exactly this (except the 2nd account part) and I'm still safe. Updated games only in OFW, deleted internet settings as soon as I'm done updating and then boot back to SX OS and made sure never to turn on internet access when in SX OS. I can still access EShop and play fortnight online.

    Atmosphere-NX is an exact copy of the Switch OS but with patches made to remove all security checks & run/inject unsigned code, think of it as another copy of your Windows 10 installation which is installed separately on a pen drive but has all security features removed to run unsigned code.

    Nintendo can simply check running processes and even memory and easily identify if a CFW is running (since it will most definitely run with modified processes which also have escalated permissions). The fact that they didn't do anything in past isn't any indicating that they won't do anything now.
