Doubt it would be called BOOTTegraStrap as a system of similar functionality to the user would be a totally different beast compared to the 3DS. As such, all you'd achieve is confusion and painful volumes of miss-information.

The number of times this trick could be pulled is extremely limited. These dumby boxes Nintendo made were only for expos and some store windows. But ya, it's still a risk.
Nah, full blown fake listing. Claimed it was a fully functional console that had barely been used. Though barely turned out to be never as, you know, it's a Nintendo mock up. That and Ebay took it down. Doubt they would go through the trouble if nothing was up.
A report published by the EU trade commission failed to find any evidence that piracy affects sales either positively or negatively. It would appear from their (some-what-small, still under peer-review) study that spending money on anti-piracy systems is a huge waste.
