I don't believe they do, but with it being nearly impossible to tell its impossible to enforce. Even when cheaters are proven to have incorrect balls or egg moves, they simply say, "I didn't breed it so I didn't know it was invalid." Off the hook.

The only way to get a backup is by hacking their console on which you lose your rights to access the game licenses. Its a null point. This argument is the same as saying "I robbed a bank, but i keep my own money there so i'm innocent."
Obligated? You paid for a license which they clearly state is cancel-able if you hack/reverse engineer/modify their code and content. I hope Nintendo requires the hardware to be sent in to undo these bans or just leaves them standing.
