Let me see if I can find a credible source. As I remember it the person who worked on the Virtual Console for Nintendo previously worked on one of the first public NES emulators and reused the iNES header format from that. That's where the idea they downloaded roms of their own games came from.

The idea that Nintendo might have downloaded roms because of the iNES header was mentioned in a presentation held by Frank Cifaldi. That's where the rumour started.

Nintendo didn't get their roms from the internet, they have their own archives of master roms for every game.
(*cough* some of those archives leaked last year, so there is definite proof of that)

Haha, I think we all dream about taking a peek inside Nintendo's archives sometimes. Getting some insight into the development of our beloved games and all the ideas that never made it to release.

Found the name again. Tomohiro Kawase. He was a freelance programmer working on early emulators like iNES before Nintendo hired him in 1998. For Nintendo he worked on the NES emulation in Animal Crossing Gamecube and presumably the Virtual Console NES emulation as well.

He is credited for rewriting iNES' sound support and he also gets credit in Animal Crossing for "NES Emulator Program".

Even if we ignore Kawase, the fact that some of Nintendo's lotcheck archives leaked recently is proof that they have their own meticulously organized archives for games. The roms in those archives are not using the iNES header format, although Nintendo does have a tool to convert them into regular emulator compatible files, if I remember correctly.
