I believe "Hacks" as in Pokemon created by applications such as PokeGen and the like. As long as the Pokemon is captured by legal means (i.e. the game or Nintendo-sponsored events), it should be fine--Action Replay notwithstanding. Pokemon Bank/PokeTransporter will be released December 27th. Pokemon Bank can transfer Pokemon between multiple copies (both physical and digital) of X and Y.
