Yes. However, I bought (and returned) a PS4 Pro from JB Hi-Fi with the same box and it came with 5.50. The boxes don't seem to be sealed in any real sense.
I just picked up a white PS4 Pro 1TB console in Australia with firmware 4.73. I don't see a date code anywhere on the box, so it was a bit of a gamble (I had to return one earlier this week as it was already running 5.50). For reference, the non-unique codes on the box are:

i used to go out to the recycling center every couple weeks and look at the crts and other electronics people would drop off. Usually screens were broken or severely scratched from being tossed around. Did find a good one here and there, but never anything like a 1080i widescreen crt.

Is it piracy if it was released for free? Not in my opinion, but I also think it's not piracy if buying it isn't owning it, and it's not piracy if you can't buy it from the original creators anymore.
