Be smart buy a copy of Freaky Forms Deluxe then downgrade the 3DS (if possible) and sell the 3DS at higher price and re-buy another 3DS at lower price=profit!
Still really unfortunate this can't help to downgrade 11.0, but why people want OOT and CN for 11.0 if you can't downgrade? Is HBL the sol purpose of them on 11.0?

They will obviously not be banning accounts... They will just probably release an unremovable and mandatory patch for the eshop version, like they did with Ironfall.

Why would that happen? It would be illogical for Nintendo to ban people who just want to buy a game, they have no idea if you're using it for homebrew or not, so they can't ban you

Nintendo has never banned anybody for using primary/secondary hax. I don't think they are gonna' start now.

i mean if someone were to use that miiverse image tool, or maybe even one of the apps that downloads the games right from their servers, i mean.

If you use the Miiverse tool, only your Miiverse account will be banned.
As for the download-from-their-servers apps, none of the homebrew ones sends console specific info to the servers, so it is impossible for them to ban you. It *might* be possible for them to ban you if you use the official eshop, as we don't know for sure what info it sends, but that hasn't been proved yet.

I get you about SNES games, but still... I think from now on will be impossible to downgrade even in the future via software only
