Hacking Xbox live sharing from Xbox one to old modded 360

Hi there.
I have an Xbox one with Xbox live and some 360 games on it and I gave my old 360 to father in law. The 360 was flashed with ix1.6 however it has not played any backups for about 3 years or more. In this time the system has been updated to allow the playing of later releases like skyrim etc as required by the retail game disks. He never plays online games however I thought it would be nice to give him access to the 360 titles installed on my Xbox one.

Is this possible via sharing live?

Has the modded firmware been overwritten?

Are there any associated risks?

I have searched but have had no success.

Well, if the 360 hasn't been banned already (Ixtreme 1.6 is a really really old FW) then you'll have to update it to the latest dash and then let him download the games from your account onto the 360 (whilst being connected to your account)

Tho a dash in the 13xxx range reflashes the DVD drive to a new stock FW.
If it finds a modified firmware, it'll halt updating.
So in order to bypass that, you'll have to flash back to stock, update and then flash to LT+ 3.0.

He doesn't need to have any cfw on it anymore so will not have to reflash it.

If he logs in on my account and downloads the games, is there any chance of him / me being banned?

Did you flashed it back to stock before giving the Xbox to him?
If not, then it still contains it.

Nope, unless the console is already flagged, then it could happen that the 360 will be banned.
