Using console memory in emunand

I have noticed that the console memory in emunand and sysnand are independent. Emunand's only uses the partition that is made at startup on the SD card, since in stock mode fortnite occupies all the memory of the console and in pirate mode I have 20 GB free and I would like to take advantage of them.
Can I install games in the memory of the emunand console without being banned?
