Is there a way to get unbanned from psn and upgrade to latest OFW? Someone I know bought a used ps3 and it was banned from PSN, I guess he doesnt need CFW since he wants to get on PSN.

No hes not. I have not heard Sony banning consoles yet like MS does. They ban you from games and ban PSN account(for cheating, being disrespectful etc not piracy). At worst you can always call them up they'll be happy to help you fix your problem.

But its like you said I think OP just not on latest OFW
