I recently got a new 3ds and I want to transfer my modding and my game save data over to the new 3ds anyway how? I tried putting the sd card in the news but it didn't work

You need both system to be in the same region. As for what to do you need to do a system transfer then use faketik to restore your pirated titles. Read the section on Can I system transfer with CFW in the 3ds hacks guide.
