Hi, so I purchased a Wii U that should arrive tomorrow, it's a splatoon bundle but if the system has been formatted I won't get the game, my question is: if the system has not been formatted and there's games on there, can I sign out of the previous owner's Nintendo id and sign into mine while still having access to the games?

never bought nintendo bundles but if it comes with a digital version then no

According to the TOS before selling the system they're supposed to format it to remove all that. If they don't obviously it's tied to their account, not yours.
