any channel that hasn't been made by nintendo will be illegal since nintendo channels aren't open sorce we had to get a blank WAD and insert the .dol to boot and that blank WAD is originally a nintendo channel.

it is ok to share patchers, installers, and homebrew channels because they dont contain nintendo code. the installers and patchers require the user to supply the copyrighted code. sometimes they make it really easy by downloading the data from nintendo themselves.

this is why it is ok to share custom levels and skins for games but not the game itself and why you can share a cIOS installer but not the cIOS itself.

No, they all circumvent the anti piracy protection. Basically the only legal way to run your own software on a Nintendo, Sony or similar device is to have a license from them to code on their machine.

Which doesn't matter, as long as you don't play piraced games on your system. It's the same thing as owning blank DVDs. Owning blank DVDs is not illegal, even though you can use them to play games or watch movies illegally. Same as with owning a flash card. They're not done by Nintendo, but as long as you don't play/have ROMs on them, they're not illegal.

That's console manufacturer's rules, not the law's... You just lose the warranty if you violate above described rules then again you need to sign / accept the EULA regarding wii beforehand... which you don't do when purchasing the wii but you do when you try to connect to wiiconnect24... Still in front of the court nintendo's EULA is not that important if it doesn't suit the laws of the very country the court held

the same type of law you break by downloading movies, selling bootleg CDs, etc. the actual law is different by country.

Sorry, I don't mean to pick on you personally, lots of people make the same mistake, but "copywritten" is not a real term. The actual term is "copyrighted". Easy way to remember? You're talking about whether you have the right to copy or not, not about writing a copy.

It can't be illegal to download IOS's considering you don't pay for them and you can download them from their own server.

it is illegal to share IOSes. they are nintendo's/broadon's code. yes, they're on nintendo's update servers. but that does not mean that anybody is free to download it from there and pass it around. it is still their property. and they actually never meant for people to be able to download and view the contents of IOSes. It is just by programs pretending to be a wii that we are able to get stuff from the server.

ok don't want to be flamed nor considered as a troll but when i've read (a big word) the Wiiconnect24 EULA it says something like this: you're not allowed to emulate / pretending / use script to connect to Nintendo update servers. So for me even NUS Downloader ain't "legal".
But sure that doesn't mean: you're a pirate, that just mean: Nintendo doesn't wnat it, even if laws where you live can allow you to do so.
Anyway glad to live in switzerland, law about this kind of things are.. flexible. ex: libdvdcss is legal tu use in switzerland but not in france (library used by mplayer, for example, to decrypt DVD content) That mean in absolute: most country in the world ain't allowed to read DVD from the Wii (with Mplayer_CE) nor from linux OS

in conclusion: rules are fail, people just have to think about what is good/can hurt others

I didn't tell my firefox to pretend to be a Wii, but i can download from the server without any problems. As long as nintendo keeps the access to the server this way, nobody can tell that downloading from there for OWN use is illegal.
