Why would it get sued/banned for using desmume and vba? If anything you would be sued for making video footage of copyright games, but they don't seem to do that often now do they. Then again, I'm not a lawyer so my word probably won't hold up in any court.

I'm no lawyer, but as long as you don't see the emulator in the video, you could claim that you're using a modified system fitted with a capture device. They can't verify that you're using a ROM that way, unless some kind of emulation glitch comes up.

I believe that as long as you claim that you dumped the roms yourself and that you don't share them, you should be fine. The emulators themselves are not illegal, they are just programs that can run certain filed (.nds .gba etc.)
