Say for example Sun/Moon isn't officially released in Somalia - would the servers then ban him for connecting because Somalia isn't on their "whitelist of official countries"?

So far, this guy is the only one that I see that has it right from my experience and from what people has been reporting.I'd actually say Nintendo never laid a trap per-se.
If they had planned for issues with copies leaking early, we wouldn't have ban waves (which tells me they're having to trawl the data [connection logs] manually and not have it automated as you would with a trap).
It's been pretty well trodden at this point that the version number didn't set the bans off (there's been reports of people using the leaked versions online now and haven't been banned) and that to get banned, you had to go online and connect to their servers in-game.
You weren't banned for using spotpass or leaving your WiFi on like some have reported. You HAD to connect to their servers directly in some way (GTS, online plaza etc (plaza defaults to local only unless you select the "online" option).
There's also been a report of a German user using a US Moon CIA from the eShop and has been banned because he played Moon before the release date in the EU (23rd Nov). That confirms the whole "version number caused it" theory is false. This also strengthens the point that Nintendo's servers know the release date per region, and are flagging your account for "illegally accessing the game before official release". To add to this, a user in another thread mentioned using a US 3DS (and game copy) in France and hasn't been banned so it might be linked to your region settings (if it's out in the US and your region is the US - you're safe etc).
tl;dr Nintendo's "detection method" is merely just detecting whether the game is out in your region, and if it isn't - banning you for connecting to their servers under the assumption the copy is illegal. This also extends to legit cart owners who got it early as their bans have not been reversed either!

Pretty sure the 002 ban you got was from whatever history you left in the last trade you did on the old game not by the fshop download. I deleted the version 0 pokemon sun and it's title via FBI. I switched over to the version 32 Pokemon Sun from freeshop. Not because I thought it would lift the ban but just in case of anything, really. I transferred my save file and proceeded to play the game.
This morning (20th) I tried to do a wondertrade and recieved error code 002-0102. Attempted to play my legit copy of Mario Kart online, and now only see error code 0102.
Thus, I am now double banned post-release.
Anyone gotten banned off of the activity log? So without going online before the release, but playing offline?
