GitLab has taken down the Suyu Nintendo Switch emulator

Emulator takedowns continue. Not long after its first release, Suyu emulator has been removed from GitLab via a DMCA takedown. Suyu was a Nintendo Switch emulator forked from Yuzu emulator, which was the high-profile subject of a takedown by Nintendo last month. GitLab deleted Suyu's repository, stating that they'd received a takedown notice for the project. The tongue-in-cheek named emulator still has an official website up, though the Discord is not allowing new members, and the GitLab download page is gone. However, it seems a self-hosted download page is still available.

Yeah, it's self-hosted now, so there's no 3rd party to send DMCA claims to. And if someone tries to use the DMCA link on the new git they'll have a nice surprise.

From what I could find, it seems like the project might be self hosted, but it's backpedaling on something called Forgejo.org, which seems to be some form of Git repository system based on Germany. They could still be attacked by DMCA, since it's still EU grounds. Until they move to something outside the usual US or EU, then they might be safe.

“Yuzu” was not sued by Nintendo and isn’t a legal entity. Tropic Haze which was a LLC setup by the devs of Yuzu was sued.

They didn’t settle because they made an emulator. They settled because there was a lot of evidence they actively facilitated piracy and knew they were doing it. Not everything in the suit was likely to be proven if it went to trial, but they had significant legal exposure on things that were not so cut and dry legal as a lot of people here seem to think.

There are so many DMCA-bully-free hosting options, that are themselves free to host too, that I really don't understand why people working in grey areas insist on using github/lab.

A single google search will give you tons:

Just pick anyone not mainstream FFS.
Becuase Github and Gitlab are the normie code hosting sites everyone knows, becuase no normie (let alone a common consumer of Nintendo products who don't even try to emulate the games) will go to this site is not github but does virtually the same thing anyways.com to compile some random emulator or download the precompiled version for thier platform.

Did some quick research on all of those.
From that list, only NotABug seems like plausible host for the suyu emulator source code, but due to it running on German servers and the members being Dutch, they could very well be victims to EU copyright laws. They need another Git-based host based on a country that doesn't give two shits about DMCA laws in order to avoid the project being taken down again.

They didn't settle. A settlement is something submitted through the court system. This was an agreement made outside the court system with no legal backing or follow up should either side go back on the agreement. The only thing we know about this agreement is what they've said about it since there's no court record of it.

You can't even download from it anymore, so it might as well be shut down.
They're still submitting commits to that repo though, last one was just 8 hours ago.
All they need to do is simply fix the links and rework the builders/conveyors for this new repository, which is exactly what they're doing with recent pull requests:

I've worked it out yall... Princess Peach is running flawlessly on ryujinx aka magically thee untouched emulator during all this bullshit.. Now what would really piss ninty off is simply make suyu load games the way ryujinx does... OMG that would be dynamite kinda like gogeta fusion ninty would have no answer for it... Leave all the options of yuzu suyu code asynch etc etc enhacements but how the game loads implement that ryujinx method of loading into suyu code but call dat shit rysuyuzu... Think about it ultimate compatibility on ryujinx side of the code then smoother performance on yuzu side of the code... This has to be possible and why no one has tried???

time to move to a russian site (ik ik the Ukraine invasion is horriable) but we got so few options now since the CCP/Tencent is in shitendo's back pocket now,the only viable option is russia
Anonymous self file hosting is a thing, something that is done with many a Linux Distro, some of which date back to the days of when Debian and Slackware were the only major Linux options. If only there was a handful of software and websites that could do just that, but I guess the need to be completely public about everything (including promotion), including any and everything that can be used by the company that can and will shut you down is a higher priority.

If any garden variety ROM site can host themselves without relying on social media or something like Github, then surely the people behind a group of people trying to continue an emulator that the code of which is currently mere baby steps from the level of changes and effort needed to differentiate it from the one that is now owned by the company that seized it from the people who flew too close to the sun in regards to trying not to get sued.
