Usually that is caused by having a region mismatch. i.e.: EUR Game on USA console. If you try to update via e-shop, the game will request the EUR update, which is not available on USA consoles/e-shop.
You'll need to fix your game's regions first, then update, the easiest way is to uninstall your current game and get the whatever region you are one, I won't tell you how and where to get those because is against the rules, so that's up to you.

Yea, check the region of your game in fbi, if it's not the same as the 3ds then it's not gonna download the update as mentioned. Then you have 2 choices, either get the game update that matches your installed game from somewhere on the internet, or install the game version that matches your 3ds then update through the eShop.

Can you access the eShop?
Do you have a NNID account set up?
Is the game (MK7) the same region as the 3ds? If not, that's most likely why it can't download the update..
Well, my my Mario Kart 7 is the same region as my 3DS, and i do have a NNID account, i did updated the game.
I'm not the one who got the problem lol just looking for someone to play Mario Kart with...
