How can we make this more clear?
The agreement said they could before! They merely reworded it to be more inclusive!
This part of the agreement was always there!

I don't think it was there before.

(OLD)
"To ensure that your Wii Console is operating properly and efficiently, we may download updates, patches, upgrades and similar software to your Wii Console."
Does not include the phrase "without notifying you".

"In addition, we may disable unauthorized or illegal software that has been placed on your Wii Console without notifying you where necessary..."
Refers to "disable unauthorized or illegal software" but not to "download updates, patches, upgrades and similar software".

The two versions of the TOS are fundamentally different in my view.

Another update... Damn you Nintendo!

After reading through 20 damn pages, I have these questions:

- Is 3.4E out? Or just for the US/JP Wiis at the moment?
- Does this delete Homebrew Channels? Some say it only does if the Zelda Hack save is on your Wii.
- Is this 'Auto Update' thing true? Some are saying yes while others are saying no.

Now it seems getting the Homebrew Channel installed won't work using the Zelda Princess Hack on 3.4X. Also to use the Mii Channel, a update is required (unless you use 'Mii Channel Update'). Also if the Homebrew Channel is installed, it will still work (and hopefully allow downgrading to. 3.2/3.3).

IS THIS NOT ALREADY A FEATURE IN WIIKEY V1? (sorry for caps lol, cap lock was on)

update your wiikey to highest version you can (1.9s i think) and then burn a config disc for it. you can cycle through the config screen and have it block game disc updates.
[/quote]Oh my god!
That's about disc updates!

However, the disable unauthorized or illegal software part does specify "without notifying".
This could not be done at that time without some form of update.

You Wii will never EVER be updated automatically without your consent.

they only download the files to your console but don't install it

Is this a stated fact that you can support with sources or are you speculating? Does the update process tell you "Update files have been downloaded to your console. Would you like to install them?" Are the update files stored somewhere in RAM or NAND while they are waiting to be installed? If you have a source for this information I would appreciate a link to it so I can read up.

Right, no one can say that having 3.2 installed will keep you "safe." As of now there are no reports of auto-updates, but Nintendo could change that an hour from now. Just because they have not done something does not mean they will not doing something. They have the ability to update any Wii out there. The only way to actually be safe is to take you Wii off the internet until someone puts out code that will completely stop updates.
No. The ability to force an update does not exist in the older versions.
It has yet to be confirmed to exist in the newer versions either.
Personally, I am skeptical. I think the agreement revision was only for clarity.
It always said they could do this, but the capability did not previously exist.
Source? It wouldn't take much for them to "force" an update with WiiConnect24 on. It would probably be more a matter of disabling their ability in past versions. Why would they cripple themselves?

way faster sd-card speed ? did they update the usb-driver?
Why does everybody assume that increased SD speeds mean a new USB driver? This is like the fourth post I've seen asking about this.

SD and USB are entirely separate drivers. An update to one will not affect the other!

Unless there's something we don't know, WiiConnect24 isn't a magical existence that can do anything it wants to.
There is no known capability for auto-updating in the older versions.
The new version has yet to be fully analyzed, however.

So it has a sophisticated task scheduler and downloads system updates, but absolutely does not have the ability to install those updates without consent?

If that page is your best source then I'm going to remain skeptical.

Yes. However, there still needs to be something to tell it "download this when this server tells you to".
That would not be within WC24 itself, but if auto-updating capability ALREADY existed, we would already know by now.
Most of the major aspects of the Wii system firmware have been researched, after all.
If it was always there, it's really tucked-away. I don't discount the possibility they may have added it in this update.
But, AGAIN, their policy always gave them the right to 'remove illegal software' etc without notifying us.
For them to do so back THEN would also have required auto-updating.
That's why I personally am not very worried about this.

Going to show me the part where a remote source manages the task scheduler?
That function is used by games to download data in the background while the system is disabled.
