Did you update your backups in CFW, OFW, or both? And I'm referring to what version of SX OS was used when you last connected online, not your Switch's firmware. Thank you for taking the time to answer the questions.

OFW, and I used the 1.1 version of SX OS to load my backups.
I never used SX OS online.

If you are banned, you can still update all of your games as well as the system firmware.
But for how much longer? Is Nintendo really going to allow users to update their firmware and system titles while banned? I know we will most likely get some form of homebrew so we can install updates and DLC but until then, who knows really?

If i'm note mistaken they're forced to do it by law(in a lot of countries), to update their system(for security resons), don't know for games, but i guess it's the same, they need to guarantee game support because of bugs... eshop is another story

To add onto what Massaci0 said, certain games require game updates to run properly. For example, if you installed the game update at one point then remove it, the game will not launch without the update especially if you have a save using the new game update. Nintendo may make the game update more process more secure (like needing a header to update) but they cannot bar you from obtaining game updates.

Just to be clear, it may not be the fact that you are updating a backup that gets you banned (again, Nintendo cannot tell the difference). If anything, the Switch detected you used SX OS, stored that information, then transmitted it to Nintendo when you updated your backups. That is only one possible theory how users were banned for updating backups. Remember that you can still update them if you are banned so it does not add up to be banned solely for updating a game.

How is it that you know Nintendo can't tell the difference between updating a backup? Especially for people updating backups without original certs headers..
Isn't what you're saying purely speculation based on.. what.. your own knowledge? Which is? Do you have some links, articles, proof?

I have been using my SX OS offline, loading my backups, then updating them on OFW. I use a dummy account for all updating and playing, it does not have a nnid. I have not been banned on my main account since the day the SX OS launched. I believe I'm not banned because Switch game updates come from their own server, the same reason why no one gets banned on PS3 CFW for updating their games. I think the Wii U was the same way as well as the 3ds for CIA's.
