well i just played some pokemon shuffle and was able to progress far enough to do a server check in and that completed successfully so whatever ban they have on me at least doesent appear to be NNID based as was stated earlier ... if it where NNID i wouldent have even been able to continue accessing Eshop or server checkin on shuffle .... this truely is odd ... however all i see it as is a temper tantrum on nintys part more than likely because there are hax out now they know they will never be able to patch lol

edit : stated earlier that it was not NNID based ... i reread what i wrote and figured i should clarify lol

We need to put a firewall in the CFW to block sending secret data to the mothership. Or at the very least we need a log file to track all the network activity so we know what's being sent.

I called Nintendo yet again, trying to find out at what point they caught me using "modified software" or however they want to describe this. I never got a straight answer, this guy was just questioning me. In contrast on Tuesday another CS rep mentioned Monday, they caught something Monday, which is strange because other than NTR CFW, booting that up, the whole day was me on Pokemon Moon. And surely at the time spotpass was disabled, it was disabled for a long time, if not the whole time I've had this console (7 months). Of course they make it clear, "You have a modified system, we cannot lift this," guy said it at least 3 times during this 6 minute conversation. I'm constantly checking the two other N3DSes I spend a lot of time with, both having spotpass disabled and the friends list app setting of showing titles disabled (both disabled eons ago), no ban yet. So really that banned console, the only opening was the friends list thing, having not disable it.

No one really knows how Nintendo KNOWS. They could be doing screen grab or even looking at you through that Infra-camera. Disabling Spotpass or Friend's List is no guarantee that Nintendo can't access your 3DS.

Okay, I'm banned. Loaded up Mario Kart 7 and it won't let me go online. As I said above I have pretty much NEVER played anything online, and my friends list app wasn't even setup @Aurora Wright

Spotpass sharing was however turned on.

Now to see if it's a permanent ban from Nintendo or if they ever lift it.

Ah that's unfortunate then but yeah that further solidifies Spotpass being the culprit :/

That's what I want to believe, but that call. I'll name and shame, Earnest, you suck. He didn't answer my question, I hate that, basically gave me the runaround. I didn't even ask the other guy on Tuesday when they found out, he just dropped that they caught something Monday.

Nice. Your testimony reinforces that the two detection methods could be indeed friends list and spotpass.

It's also possible that they keep logs of the information (depending on what they use it for), and so people who ever had it enabled + installed homebrew titles were banned.
Another cause might be the friends list, since if you show your currently played game to your friends it needs to be sent to Nintendo (or if you stupidly set a HB title as favorite)
Well but it doesn't make sense for me. I've used so much HB, and I've used FBI while a friend could see it (we saw it because he was in direct), and I'm not banned, so I don't think it has something to do with this...

im on Luma3DS and i haven't Open my 3DS yet If i Turn off my internet and Go to Spotpass and turned it off and the next time i turn my Internet on in 3DS I Still get ban???

Seems so. Trying to find out 100% is always a futile task anyway. Nintendo will never give a fully factual answer and communities will be left with best guesses. Like with Sony and MS Nintendo have a ToS that says not to use CFW/modified software so they can ban if they want much to the frustration of everyone.

Right now it seems the eshop/updates and other things will still work. We'll maybe find out soon if FW updates will still go ahead too. It's MP they've completely shut down. I guess this is one way to nuke cheating online, as anyone with a modified system will probably get flagged and banned eventually. Remember these companies often do ban waves.

Will be interesting to see if they start banning Wii Us from playing online. The other nightmare for the general public is the 2nd hand market. Given how easy it has been to modify the 3DS and with the perception of no bans, there is now going to be a massive risk buying a 3DS second hand. More so than something like a 360 if you ask me. MS/Sony have always banned quite quickly and strongly, whereas many have felt safe modifying a Nintendo device.

If you've already been spotted with modified software via information sharing or the Friends List, then yes, you can still get/already be banned.

Hmm yeah, I hope the CFW and exploit programmers are able to implement safeguards to minimize the risk of being detected as much as possible. Who knows maybe we can disable the whole "phone home" module or maybe add a module that redirects the sniffing URLs to 127.0.0.1. I do think that updates and such still have to work, atleast in the EU because while it's well in their right to restrict online access I'm sure the EU will give them hell if they practically stop 3DS's from working normally with homebrew being legal here.

I'm also all for banning online cheaters and hackers and I think a whole online blanket ban is rather unfortunate even though I understand why Nintendo does it. I bought all the games I dumped as .cia's and the last time I "cheated" online in any way was when I was 16 or so, WoW Burning Crusade was new and I glitched myself with friends under Stormwind City :P Okay and one time I ended up in hacked lobby in Modern Warfare 2 but that wasn't my fault :P

But yeah you raise a good point, I would advise nobody to buy second-hand 3DS's until the reason is 100% determined and we can see if anything can be done about it :/

I've had it all enabled. Spotpass, Sending info, ALL OF IT and im not banned and i use my 3DS frequently..

My guess is that they've been collecting data at specific time frames and some people just lucked out.
That or you're scheduled to be banned in the next coming wave.

I was banned. Then I turned off "Send Nintendo information", and now I'm fine! I just went on Eshop!

Edit: Just went on my Friend List, and I'm still banned.
