If someone owns a copy of super smash, releases the header publicly, sells it on eBay, and the buyer plays online and gets banned, how is that the buyer's fault?

No lawsuit can be made against them for THAT, but if they ban people for simply using their GW card, the victim can call them and demand a lift on the ban due to it no longer being owned by ( "Store name here"+"Nintendo" ) They can only ban people if it's in violation with laws based on the user's country. So in other terms, Nintendo cannot even be placing these bans unless they have proof that the user is using ROMS. Otherwise, you cannot be punished. I called them until they lifted my ban, after a call explaining how I was using a Gateway card; I didn't stop calling them until they did something and to this day, I use my own server to play online.can't Nintendo get sued for this? Eh... A 2ds costs $100. A legit store sells them. A 2ds costs $35-$50 on some site. 90% of the time, you'll get scammed. So, if it arrives legit, nice! If not, it's kinda their fault for buying from them... It's kinda rare to actually get what you paid for.Not at all. In UK they cost £35-£40 (Work that one out in CAD) for the cart, and ~£180 for a 3DS
