Valve DMCA's both "Portal 64" and "Team Fortress 2: Source 2" projects

Valve has been one of the few gaming companies that has been in good terms with the gaming community for most people. Their customer service and Steam support has been one of the best so far, and their success and support for the Steam Deck system has been also received fairly well worldwide.

On January 10th, 2024, Valve issued a DMCA takedown to the GitHub repository for the "Team Fortress 2: Source 2" project, which aimed to Team Fortress 2 into the Source 2 engine, the same engine that powers games like Half-Life: Alyx and Counter Strike 2. The takedown seems to have taken place due to porting and redistributing Team Fortress 2's assets into the Source 2 engine without permission, as stated in the DMCA notice on GitHub:

The original copyrighted work is Valve's game Team Fortress 2 ("TF2").

The TF2 assets have been ported to Source 2 without permission and are being redistributed by Amper Software in a game mode for Facepunch's S@box. Facepunch has not licensed any Valve assets for S@box. The unauthorized porting and redistributing of Valve's assets without a license violates Valve's IP.




To make matters worse for TF2: S2, the project was undergoing an engine rewrite, and the takedown appeared in a time where the current source code for the engine is all but unusable, effectively killing the project in its entirety.

Sadly, "Team Fortress 2: Source 2" isn't the only project that has been taken down by Valve.

Another highly praised fan project based on a Valve IP has been the technologically impressive "Portal 64", which aimed to recreate the entirety of Portal 1 into the Nintendo 64 as a fully developed game that could run on the original hardware. The fan game had just received a new updated this past January 5th, 2024, titled "Portal 64: First Slice", which saw 13 of the 19 test chambers from the original game fully playable up to that point.

This also caught Valve's attention, and it prompted action from the company towards this project. However, unlike the Team Fortress 2: Source 2 DMCA takedown, this takedown seems to have been caused due to the project's usage of "Nintendo's proprietary libraries", as mentioned by the project developer, James Lambert, on his latest Patreon post:

Because the project depends on Nintendo’s proprietary libraries, they have asked me to take the project down. I am letting all you know before so you can choose to withdraw your support before the next payment cycle. I do still plan on continuing the channel. I have plans to do VR powered by the N64, a computer that runs on air pressure, and some other ideas kicking around in my head.

I understand if you no longer support the channel but if you do stick around let me know what sorts of projects you would like to see. I may start a new game of my own or continue to find interesting ways to push N64 hardware. I haven’t entirely decided what I will do yet.

Also, but (sic) sure to generate the latest ROM before I take the ROM patcher down.

The ROM patcher for Portal 64 is still up at the time of writing, so those that still want to get the latest and final version of the Portal 64 project, can still do so before the ROM patcher for the project gets taken down in its entirety.

So basically like every semi-competitive multiplayer game that doesn't use intrusive kernel-level anti-cheat, then. There's a good reason cooperative multiplayer games gain traction easier at the moment.
That literally has absolutely nothing to do with what we're talking about. Overwatch doesn't have intrusive kernel-level anticheat and it isn't plagued by bots. There are many many more games that don't have the same issue without any deep rooted anticheat. There's absolutely no correlation between those 2 things.
Simply releasing one F2P game and pouring all resources into it is an awfully low bar for "consumer-friendly." Valve gave away indie games all the time before F2P was really even a thing, not to mention marketing the hell out of them at a time when nobody else was. Warframe is on Steam for a reason, after all.

Again, I can enjoy and acclaim Valve for doing some of the best stuff we've seen on PC, but they also have done some of the worst, they have been pioneers when it comes to garbage micro transactions among others and I'm not going to forget that whatever good they do. Almost everyone forgot about selling Steam keys in boxes that had a cd slot lol. Same with paid mods.
The point I was making is that Warframe basically made the same system as CSGO (you pay to open something random that you can sell to other players against a premium currency) but retracted it because it was predatory, Valve doesn't care. When it comes to monetizing games, Valve is not as bad as some, but to say it's not possible to be more pro-consumer is getting way too far. Releasing a single game and pouring resources into it has absolutely nothing to do with the conversation we're having, it's about what they did vs what they could have done.
You can't hand-wave away the features Steam provides or how much it's been improved over the years if we're talking about Valve's history of consumer-friendliness.
I'm saying they're doing the bare minimum to stay relevant and you mentioned EGS, which is just another subject. The bare minimum isn't the same for each company, since Valve relies so much on community support and on the Steam ecosystem, they do have to be pro-consumer in some sense but they try their best to not be too much, just like any other company.
Again, you wouldn't have refunds if it weren't for Europe. Same for sharing. They recently lost an antitrust lawsuit for geo-blocking in Europe. It's almost a challenge for them to break european rights.
Steam is obviously not doing the bare minimum for a PC launcher when it comes to features, but that's because the scope for EGS and Steam are so much different.
Epic's business model is getting kids to use their parents' credit card to buy V-bucks, so yeah, obviously their business model isn't the same.

I'd rather have kids paying for a battlepass that gets refunded everytime they complete it (pretty easily) than having them on virtual casinos trading virtual knifes then cry because they got scammed. That also doesn't describe how any company expect to grow.

Totally agree. The requirement comes from them just not wanting to start loosing money. That's what I call a requirement. A company that starts bleeding may recover but it'll never be the same, Blizzard knows that.

The thing with Nintendo is that they have a very very passionate fanbase but most of their customers are people who don't know or care. So they can do anything they want to their passionnate fanbase and it'll be fine when it comes to sales. I feel like a company that is in a similar situation would be Rockstar.
I still hate the fact that SwSh had the best launch for a Pokemon game. I'm pretty sure it wouldn't have been possible if people who were vocal about everything around the games had canceled their preorders.

Nobody cares enough to bot because there's nothing to be gained and the game isn't fun to play. Overwatch sucks on multiple levels after the terrible decisions Blizzard made with OW2, which is part of the reason it was one of the first Blizzard games to end up on Steam. With overwhelmingly negative reviews, to boot.

MTX did set a bad example, but the example nobody else followed is the ability to resell rare items on an official marketplace for potentially big profit. There was plenty of value to be had for TF2 players in that regard.

Do you really think keys in a box were meant to be some sort of slight against the consumer, or do you think maybe some were misunderstanding one of the primary benefits of Steam as a platform at the time? People were tired of downloading so many patches and no-cd cracks manually, and that's the reason Steam started to catch on in the first place.

Epic was found liable in court for predatory monetization targeting children and making it too easy to "accidentally" buy stuff with their interface design. Being that they're nearly half-owned by Tencent, it can't really come as that much of a surprise. Valve benefits massively from remaining private.

No company wants to lose money, not even Nintendo. Difference is that Valve has only continued to make more and more, year over year, since about 2010 or so. With Nintendo it's been all peaks and valleys.

The launch timing couldn't have been better for Switch, but I do wonder how Switch 2 will fare in a more competitive market if Nintendo decides to cheap out on the hardware again. Lots of alternatives with at least three times the power out there now, so that could eat into Nintendo's 18+ fan base.

Such a massive step backward from Legends Arceus, I have no idea how Game Freak managed to trip over themselves like that. Cassette Beasts is the best modern "Pokemon" game available now.

we should all remember that who hunted down dolphin on steam was Valve themselves. They just asked Nintendo "should I pull the trigger?". Obviously Nintendo said yes.

Also, Valve collects an obscene amount of data from it's users, so that good guys image is just a build up image, it is not a real thing since forever.

(oh, and there is the DRM subject, but people are ok with that so it seems)

You don't own anything you license on steam.
You can't even resell your licenses, and they can terminate them at any point.
That pretty much lobotomises consumer rights.

Valve has done commendable work with their controller API and proton,
though people have to remember that they are still a company, their goal is to make money.
That means that there automatically is a conflict of interests between them and their customers.

The portal one i can understand if theyre using leaked nintendo libs valve probably doesn't want to get in trouble with them. Regarding tf2 it makes me wonder if theyre releasing a tf2 on source 2 or tf3 soon so dont want anything impacting their release. Valve is usually cool with stuff like this so its certainly strange

I've never really understood the hate for key/lootboxes when i was younger and into counter strike it got me and my mates out of the house we would go hang out in town to buy steam giftcards lol i didn't go out much other than that. I dont really see them as any different to things like pokemon cards which are basically gambling too

Now that I think about thia after learning the truth, it's extremely funny seeing people on Twitter losing hope of Valve and their future of gaming altogether meanwhile Valve's reason for the takedown is logical.

I've even seen one comment saying that they might aswell take town gmod because it wasn't published by them and someone quickly showed them the steam page where it was published by them.

No matter what anyone says, Valve is still just as great as before.

If valve is seen as endorsing a project that is using stolen nintendo libraries nintendo could sue them and im sure they dont wanna deal with that nintendo is extremely litigious when it comes to their ip. It also could cause problems with valve not being able to sell games on nintendo platforms

Valve has to maintain a good business relationship with Nintendo. Valve's IP plus Nintendo's proprietary code puts Valve on the legal hot seat just as much as it does the developer of the project, if not more so.

The focus with Nintendo should be decompiling and porting more games OFF of their hardware. That's the only way fan projects can gain any freedom from the ninjas.

Haven't commented, but this is more or less the point of Valve requesting the shut down of Portal 64. If it was just Nintendo assets involved in Portal 64 alongside the libraries, that'd be one thing. Valve would have no reason to request the cancellation of a game that doesn't even relate to them in any way.

However, the fact that it also includes Valve assets means that Valve can be perceived as being just as guilty if they remain silent on the action. Which could lead to Valve itself being taken to court if there was any reasonable suspicion that they gave the dev approval to proceed with the project. Given that, Valve's actions can be seen as a precaution to prevent damaging their relation with Nintendo, which they may see as more valuable than allowing a third-party dev to use their IP in the process of infringing Nintendo's copyright of the proprietary code.

That being said, it seems like it doesn't matter what Valve's reasons are, as people are quick to paint Valve as evil for making a smart business decision regardless.

Destroying fan projects that people have put hundreds of hours of work in just because they've used a line of code that Nintendo "owns" is dystopic.

If only they were at least CONSISTENT in enforcing their copyright, but no, actual fan projects without any intent to harm Nintendo get the hammer while "Super Bob's World" and the like that use Nintendo's copyrighted artwork in their advertising are left unnoticed for decades.

That's very sad news! I love Portal games on PC. I remember play Portal game on Windows XP is my first time. Then play Portal 2 on Windows XP but give me crashing, crashing all of times (kick me out to desktop) between chapter 3-4 where big wall machine killer come toward us. Portal 2 game crashing did removed my Nvidia Control panel on Windows XP, and first time turn my colors to 8 Bit, that's very weird happened to me! I know Portal 2 game is worst ever on Windows XP and above due to crashing problems then I done with it. I did try Portal 2 game on Windows 7 but still crashing, crashing (kick me out to desktop) for no reasons! I give up Portal 2 game for Windows and force to use Nintendo Switch emulators like Yuzu and Ryujinx then load Portal 2 game is running great without crashing on my Windows operating system!

We know Nintendo 64 have poor library of list games. Means Nintendo 64 don't get enough good games as we know.

We need Portal 2 64 game on Nintendo 64. Most people already had Everdrive and can choose many games on list which to select one game then play it from SD/SDHC/SDXC/microSD/microSDHC/microSDXC cards.

We need more demake games port from PC, PlayStation, Xbox, Nintendo (GameCube and above like current modern games) on Nintendo 64 to build more bigger library of games list would be awesome!


I did heard about Portal 3 game is planned to release out soon by Steam/Valve company. But no thanks to Steam/Valve company for me! I stopped support Steam/Valve when company did kill support off on Windows 7 on Jan. 2024! No way! I give double thumb down to Steam/Valve company is worst ever right now! We and people should give "Failure" of Grade to Steam/Valve company! No joke! I done with Steam/Valve company! Steam/Valve company will face massive blackout internet servers when it will going down then a lot of people will get very angry and people will fill heavy lawsuits against Steam/Valve company in court for to fines about millions or billions of dollars damaged! :hateit:

I forced myself to GOG permeant forever because GOG company did care for PC games on old Windows operating system like Windows XP, Vista, 7, 8 and keep going on toward into future. I love GOG company is much better than Steam/Valve and other worst companies which don't care to support old Windows operating systems!
