until recently in the usa your isp could not give up your personal info. most isp's in the usa will still keep your personal info private and just send you a treating letter unless the copyright holder is threatening legal action. most of the time the copyright holder will just accept in good faith that you will no longer share said file. downloading backups in the usa is not legal even if you own the game. other countries have different laws. the best bet if you are afraid of legal repercussions is to not download games. If you are careful about what you do and where you go online you shouldn't have to worry about these things.

I don't use torrents, I prefer sites like Megaupload. If I need something that a torrent has I'll have my dad's friend get it, he constantly downloads and is going to give me some games. He has like 500+ Wii games and my Wii is the only Wii in the house capable of reading backup discs (I don't have any external hard drives, but I need a couple, one for my Wii and another for my computers), it's also the only Wii with homebrew since my sister and step-sister still have warranties on theirs, one wants homebrew, the other doesn't, I told her to wait until her warranty expired since that will give her time to learn how to softmod. She really needs to know this info if she's going to do it since I don't plan on living here forever. It's not like it's hard, but she can't even figure out how to install MSN messenger, so I don't wanna teach her to softmod.

Eh, torrents are too dangerous for me, as I said, if there's something I want there I'll have my dad's friend get it for me. He offered, I'm just taking him up on it.

Torrents are really useful only when you need to find something old, or something that you just cant find. Other than that, use megaupload. But if my site doesnt have links fast enough, i will usually just go to my private which will have it. Ive been wanting to get usenet, but im not quite sure what to get.

A - Shut you down.
B - Face a lawsuit for helping to hide/continue illegal activities.

It IS in their interest to shut you down.

Wow, such a hot thread.

The whole thing about C&D letters and ISPs watching you has been going on for some years now, first in America where Piracy was most prominent at the time, then it started spreading quite quickly to many other countries. For a while in the UK, only a certain 6 ISPs signed up for similar rights to monitor their user activity, but now a whole slur of legislature changes are taking place to take it to the next stage - that'll take a year to implement, and that's before the inevitable appeals because the government pulled some rather shifty work trying to slip in clauses and extra rights that downright infringe on all rights to privacy.

On the other hand, Piracy is effectively stealing from the gaming industry. If nobody pays for their games, the developers don't get paid for their games (not to mention retailers and distributors) and can't make newer, better games for us all to play. Fortunately the large majority of people DO pay for their games, but there're still the large numer of people who don't (some self-confessed in this thread).

Torrents aren't safe. Private trackers may be slightly safer than public ones (because it's harder to monitor private trackers) but the ISP will still see P2P activity and start watching it to see what nature of torrents you're getting. All of this is easy for them. On the plus side, most ISPs (but there are some that will) won't pass on your details until someone's made an accusation/case against you. Then, as Rydian repeatedly pointed out, they won't think twice about handing over the data.

If you try moving to another ISP, they always know what kind of user you are - the previous ISP will pass over relevant data to them so that everybody can keep an eye on you and make sure you don't carry on downloading illegal content. Switching ISPs does NOT make you safe.

Personally, I keep my pirating to a minimum (try before you buy mentality), with the exception to Anime. It's so hard to find normal priced anime in shops (they tend to be American imports) that a graduate like me can't hope to afford them, so there's not much chance of buying the 1.1TB of Anime I have. That said, I still try to when I can find a good deal at MCM expos, so I currently have a bookcase full of them, but that's only a drop in the pond compared to how many other series I've seen and want.

ISPs don't care what porn sites you download from. But they know. They just want your muney like everyone else. I will not be concerned until the police comes with a warrant and seize the day. You don't even have to change ISP just change the name on the bill...

Your ISP really only cares if the people holding the copyright care, otherwise they won't really look into anything.

Also a suggestion to anyone who gets a warning letter (not cease and desist like the OP) don't reply to it, that's just confirming to your ISP that you're the one downloading the copyrighted material and it's not someone else using your internet.

If you get anything like a warning letter just don't pirate for a few months and you should be good.

WoW

After reading this I'm glad we have a great privacy law here in Holland.
If they want to do this to a person they have to go to court first
We can download everything here as long as you have the original game/movie.

Indeed. The only time I've ever seen an official saying that backups are okay were in the fronts of Wii and DS game manuals, where it says you can have a single backup, but you must back it up yourself, and it can only ever be used if the original copy is destroyed (e.g. in a fire).
Uh, you sure it says that in Wii and DS game manuals? I doubt Nintendo would mention it even if it were true that its legal to have a backup (I really don't know, but I think it IS legal to have a backup)

Not true. It's only legal to make a backup of your own personal disk. You can't get it from the internet for any reason.

In the US.

In other countries, laws are of course different. Here in the UK, I'm fairly sure its legal to download a game if you own it.
