Would that soft-ap be an open hotspot?
It can be whatever you want it to be.
The most reliable way to do a softAP for DS is with one of the OG Nintendo Wifi USB Connectors. Either with the official driver which just lets it be used with official software or a modded one that was intended to let it work as a general purpose softAP (for use in homebrew as well as official games)
Both of those drivers are hella old though and you'd probably need a XP VM to make them work.
You could also try Connectify Hotspot which works on Windows but I had no luck getting it to work in 3DS software, never tried it with DS software though.

Connectify works great for 3DS, use it all the time, but as far as I know it only supports WPA2.

I think you can do an open AP with MAC filtering but you might need to pay for it to enable that?

I have paid license, mac filtering isn't an option, and you are required to set a password.

I don't think Windows nowadays even supports creating WEP hotspots anymore, it may still be possible to create open hotspots but Connectify only does WPA2. Linux works though, or so I've heard.

    @The Real Jdbye What don't you get? If someone use a stolen creditcard. Then sell said key on G2A. If I the dev sold the game key, I will get the charge back cost. That's how it works, it doesn't matter if I generate 300 keys if 300 of them are bought with stolen credit cards. I never said it was on Steam, but its the dev that gets hit. There is a ton of stories out there if you google it.
