five situations that I think piracy should be permitted

I read that Michael Pachter stuff about on disk DLC and I start to think about it. There are situations that piracy should be allowed in my opinion. I'm not saying that it will be legal someday, probably no legislator is thinking about it.

But here is the situations that I think that piracy is not an evil thing:

1- On disk DLC: If I paid for it, I have right to access everything on it

2- Unavailable content: If I can't buy it anywhere, It is not "evil" to download it.

3- Abusive Prices: In the past, games in Brazil had a cost about 2 times of a weekly minimum wage, this was abusive. Piracy at that time was a rule here. Now the things are better here. The wages went up, and the game prices keep at same level, so It is not abusive anymore, but I don't know how it is in other parts of world, maybe there are places with abusive prices yet.

4- Emulating previous buyed content: If I have a Snes game, why is illegal to play it on my Wii, my PC, etc? (Ok, I know nobody will be arrested for it, but it still is a problem for us, I have double buyed a couple of games for my 3DS for example).

5- Backups: Play backup games is not wrong at all. I prefer to play my Wii games on USB loader to keep my disks safe from scratches and damages.

That is my points of honor!!!

A lot of this seems like "excuses".

1. Well, I guess I agree, but this whole argument can be extended to all DLC unjustly. It's hard to determine whether something is "on-disc DLC", or "day one DLC", or even just "held back DLC". For all you know a big piece of DLC could just have been cut from the main game to be sold later for more profit, but no one will think twice of it because it's not on-disc or in the launch window.

2. Generally this is true but you can import and with digital distribution, it's hard to find something that isn't available.

3. Gaming is a luxury, if you don't like the prices then find a new hobby.

4. I'll actually agree here since technically you bought the product and have some rights to using it.

5. Agreed as well but this excuse won't fly with any type of actual authority.
 
in cases i think number 5 would be the best one and "if you own the game you are using from a usb loader i dont think there should be a issues there if you guys know what i mean" now if you plan to download games without paying for them then thats a different story

What do you think about the ARMv6 game porting movement? Do you think that should be allowed too? I'm just curious on your take. If you're not familiar with the situation, basically there are groups of hackers who take the time to port ARMv7 or high end Android games to devices that are low end where the game never even shows up on a ARMv6 device's marketplace. Would this count in your "game not available" situation?
 
I believe #5 is a grey area. As long as it's a backup of YOUR COPY, ONE YOU YOURSELF MADE, then that's ok. If you download someone else's copy then that's like...bad. Or something.

It is hard to me to counterpoint you because you have some solid arguments here, and I do not dominate English so well but I'll give a try:

1- You have a point here, I agree that is almost impossible to determine if the content was already available at release. The developers can easily "hide" this kind of data, I'm not a specialist but is not hard to know that. But talking about the subject was enough to make companies like capcom reconsider the DLC politics.

2- Old games are hard to find, and in some countries (like Brazil) import stuff is not that simple. But in most cases I agree with you.

3- It may be considered an excuse here, but I cant agree that gaming should be a privilege for few.

4 and 5 - I think we agree on that.

An ISO database for example, is illegal and we have no concept to support it. But cfg loader wii for example, is a legit software (in my opinion).

I have no knowledge of this project, but if I'm not wrong, they are porting software from one system to another "lowgraded", right? Well the game is available, emulate/port should not be wrong, but people still can buy it, so it is available.
 
Never said the software was illegal, just that you can't use other peoples copies to play them. As long as the backup is a backup of your copy that you made, then everything is fine, you can play it any way you damn well please. But if you download a copy of the game instead, that's illegal.

I understand that, and agree. Download a ISO of Mario Kart Wii is illegal, but extract ISO from my original disk and use it is ok.
