new 3ds xl keeps freezing when going to home menu

when i play a game for a bit then go to home menu the menu just freezes and i am unable to close the game, not sure why this is i have tried going into recovery mode and reinstalling the fw but it didnt help, sometimes it does get to the home menu but when i press close it then freezes

I got the exact same problem with my new 3ds xl. No CFW.
