Could Nintendo do this DMCA bullshit if the repos were hosted in EU? I don't think so, as the EU law is much more end user friendly when it comes to security circumvention (on stuff you own with no profit gain...).

What you can sell, however, is the licence. But this sellability depends on the EULA or ToS, which has to abide by laws in your country. So you can allow people to resell licences for their digital games.

My friend has an interesting problem with his Switch. He is currently on FW 10.2.0. And he can't update it no matter what he tries.
Trying normal System Update via Nintendo servers gives him: "Error Code 2002-0038, Not enough free space in the save destination"...
