I remember years ago on eBay when someone wanted to sell copies of DVD’s, or something similar, they had a clever idea. The seller would offer a pencil, or something else with minimal monetary value, and then list the copyrighted item as a free included gift. I’m curious if this is a legitimate way to sell copyrighted items without having the listing removed.

I’m asking this because down the road I would like to sell my hacked switch and this seems like a good way to avoid any sort of copyright issue.

I remember years ago, a car dealership near me had a promotion/commercials on tv, selling a stuffed teddy bear for $25,000 and with each purchase, you receive a free car. It only lasted a few months and they stopped doing it because they claimed they were contacted by the USA tax dept, and was forced to stop. Not sure how true, or if legal or not.

You may not distribute copyrighted content if you are not the rights holder or authorized by the rights holder. Taking money for it makes it worse, but it is illegal regardless of any stupid tricks.

However, depending on jurisdiction, selling a hacked console without games should be no problem. Ask a lawyer. Platforms might choose to not allow certain offerings even if technically legal.

I think such things shouldn't be discussed here. Any advise to make money from copyright infringement is bad and might make GBAtemp a target "because the site is condoning piracy".
That goes beyond the usual attitude of many members more or less openly (or even proudly) confessing piracy.

If you're selling a hacked Switch and the "copyrighted content" is just the custom firmware, I think people are listing them as "unpatched"; buyers will know what's up.

If you mention anything about piracy or other banned terms, your listing is likely to get reported and removed.
If you can somehow get the point across without making it obvious (as people frequently try to do with hacked consoles), it might slide under the radar. The problem is how to make it searchable without mentioning any banned terms.
Listing something as a "free gift" makes no difference. It's still part of the purchase. Everyone knows there's no such thing as free. And nobody is dumb enough to think that a pen actually costs $300.

@BigArnold, sorry but i cant, i dont have a switch. also what k3nv2 says is a joke
  • B @ BigArnold:
That's what I figured. I put a post up in a forum but no one seems to replying to posts there. I also don't what this chat is attached to.
  • K3Nv2 @ K3Nv2:
    General chat as it implies
  • Xdqwerty @ Xdqwerty:
@BigArnold, try posting in the "switch noob paradise" thread
  • B @ BigArnold:
That's where I put it. But like I said other people's posts from a day or two ago have no responses. I'm not sure if the chat is part of the Nintendo forum that I'm on or a part of the website as a whole.
  • Xdqwerty @ Xdqwerty:
@BigArnold, part of the website as a whole
  • Xdqwerty @ Xdqwerty:
    then try making a thread
  • Xdqwerty @ Xdqwerty:
wait you are too new to be able to do that
  • B @ BigArnold:
That's fine. I'll find my way.

@BigArnold you put the fusee or hekate.bin in the hekate/ payloads folder, or use app to push the payload to switch while its in rcm mode

  • B @ BigArnold:
The problem is is that TegraGUI isn't detecting my Switch despite it being plugged in and in RCM or maintenance mode.

  • BigOnYa @ BigOnYa:
Did you click install driver inside the tegra app.
  • B @ BigArnold:
I did all of that stuff and it seemed successful but still nothing. The only thing different from the guide I used was that my device wasn't showing up as APX but rather Nintendo Switch.
  • B @ BigArnold:
I did it inside the Tegra app and Zadig.
  • BigOnYa @ BigOnYa:
Try a different USB c cable, or different USB port on your pc.
  • B @ BigArnold:
I tried a different port and don't have another cable. I'm fairly certain there's no issue with the equipment I'm using.
  • BigOnYa @ BigOnYa:
Some cheap USB c cables don't send data, they only charge
  • B @ BigArnold:
The cable is usually used to connect my controller to my switch's dock.
  • BigOnYa @ BigOnYa:
Only other thing Id suggest is using a phone/tablet and use the Rekato app, or different pc
  • B @ BigArnold:
    Okay then.
    Thanks for your help.
