It's not an actual game but just a few recreated segments.Beautiful. Reminds me of Chrono Resurrection back in the early 00s, or in other words expect a rapid cease and desist order. It's the law but man if only companies would hire these fans who re-create their games and put them in charge of a team to make said remakes a reality. Alternately, those who insist on doing this stuff independently should never release footage or talk about it until it's been completed and has been uploaded and therefore will always remain available in one way or another.

Money changing hands (probably including donations and adverts on a site) would certainly hurt a case, though one does have to wonder if it is perhaps more because money tends to also mean wider distribution. There are quite a few cases of fan works and such brushing up against such things ( http://grrm.livejournal.com/151914.html having several nice examples from books/comics), and if you read the likes of http://www.xbox.com/en-gb/developers/rules and have read so much as an overview of trademark law then you will recognise a lot of trademark stuff in there.I think it's only if they use it to make money.
