Lets say I have a 3ds game card and downloaded a cia of the same game to use without having to use my cart. I mean its the same game but ones a retail copy and ones a eshop copy. Are they still considered the same?

Does eshop version exist? If so then yes it is piracy.
If not, then probably not.

Also did you say downloaded? You cannot do that. You need to dump it and convert it to cia yourself.

Yes, that's considered piracy.
The only case where playing a ROM dump isn't considered is if you dump it and keep the backup to yourself. In all other cases it's considered piracy.
However, while it's technically piracy it's at least ethical.

If you wanna play pseudo backup you need to back it up yourself ! Then yes it is piracy. It is also piracy because you use unautorized code on the console.

Pip'

So I could backup my irl friends game and play it, or is that frowned upon? I think that actually goes into the piracy side right? I mean Its the same concept as if you went to gamestop bought a game dumped it and took it back.

The last one is also piracy. Backing up games is illegal in any way.

The question, how much do you care? Want to be sure you're on the right side of the law: don't mess around with any form of backups.
If that is not your problem, you should just look at yourself and judge for yourself what your personal moral code is on this matter. Who gives a rats ass what people on the internet think?

He is probably aiming at starting a flame war as his post count and avatar suggests.

Guys, I didnt want to start anything, was simply asking questions. I see now how no matter how I question it people will always have differences and its everyones opinions. I understand what you mean btw about the morality of it all :) I had a friend in HS who got caught downloading music from limewire and had to pay a TON of fines but that was along time ago anyways. Thats always been my cue to be careful about my choices of piracy :P

creating an unauthorized backup (does not matter if you own the game, you dumped it yourself from your own cart, downloaded it from the internet) is piracy

One thing that just occurred to me.... The sound on the 2600 sucked less back then the harsh sound we hear now is from infinitely better speakers we have now, back when the 2600 was new speakers produced a almost muffled sound, like CRTs made old graphics look slightly better.
  • Psionic Roshambo @ Psionic Roshambo:
I wonder if I could recommend that to some emulation devs that perhaps the sound could use some smoothing out to simulate those old TVs
  • Psionic Roshambo @ Psionic Roshambo:
I think a few of the early systems could benefit from that, at least up to the 8 bit generation, by the 16 bit generation I think TVs had gotten a lot better in almost every way
