I know the game is free but I was just wondering. I'm not that knowledgeable on 3ds hacking so I don't know the answer.

You probably won't get banned for anything on the 3DS these days, unless you cheat online.

Not including issues with 3ds files on flashcarts, there are only a few ways to get banned on the 3DS:
- Cheating online
- Playing online with a game that hasn't been released yet
- The CFW ban if May 2017, which was largely due to installing illegitimate titles like freeShop or FBI to the home menu

I predicted they would have stopped this summer, but I was wrong. 3DS and Wii U online play are still going strong. I play Splatoon 1 and Ultra Moon online on a regular basis.
The Pokemon "Global Link" got shut down, but that was pretty much just a web interface. All other online features still work fine. I expect we would still have the official Nintendo WFC (for DS and Wii) if that network wasn't beyond Nintendo's control.

You won't be banned for installing any CIAs. If you were to install a fake ticket and try redownloading the game from the eShop, then you could get in trouble.
You will only get banned on the 3DS & WiiU for using cheats online, anything else and your perfectly fine!

Banned for cheating online? You only get banned if you enable spotpass in the settings. Not the spotpass in-game
