I was told there are not actually region free

You're wrong, the shop channel can tell if you've bought a game or not. If you have bought it then it is tied to your Wii shop account. If you have not bought the game, you may be able to redownload it because the ticket is still remaining but the shop channel can still tell wether or not you've bought a game.

True, it does say 'signing' when patching though. Other than that i don't know mate. If you look at the source of the patcher ( freethewads.c ), the common-key.bin isn't even mentioned in there...
