There was security and it was bypassed. Nintendo tries to make it more secure but there is only so much that can be done. Piracy from the eShop CDN isn't so easy anymore though.

The Digital Millennium Copyright Act (DMCA) likely applies here, as you are bypassing access-control measures put in place to prevent unauthorized software from running. Game consoles weren't granted exemptions unlike most other devices (like smartphones).

People hack their consoles because they want to remove the restrictions of the stock experience of the game console. This has been going on forever now.
