Nothing is going to happen to the Hardware although my guess is you might be banned from e-shop, not sure about street pass though as it doesn't require any login but oh well who knows.

I think that they might ban extra features like StreetPass and Online functions. I doubt they will do anything to the hardware.

They'll block hacks as they come out.
That's what they'll do.
It's the only thing we can confirm by using past data.

They will NOT brick your system. Then they get sued, because you sued them.

Next, they will block your system of ALL online services; like online gaming, E-Shop and else. The same goes for wireless options; they will block you wireless connection, means no multiplayer anymore.

My thoughts lol

Miyamoto has secretly been working on Pikmin 3 real edition, when Ocarina of Time 3DS is released pikmin seeds will be hidden in a secret compartment of the cartridge. When you open the box and sunlight hits the seeds they will begin to germinate and by the time you've started playing they will be fully grown. While you're distracted by thinking up ways to kill Navi again the pikmin will search for DS carts and will check whether the logo matches the retail game database that is constantly being transmitted to them over streetpass. If they detect a flashcard they will expertly disassemble it and share the pieces equally between them then run back to the secret Nintendo anti piracy headquarters who will reassemble it and replace your micro sd card with an identical "classified - project brick" clone. With the new cart they will return back to your house and hide it down the side of the sofa (thus explaining the mystery of why you can search for stuff once and not find it but do on the second try). You are now tagged as a "dirty pirate" and the pikmin will sneak inside your 3DS and will occasionally wobble the top screen when your playing as punishment for your crimes. When you finally find the flashcard and turn the 3DS on the pikmin will activate project brick which replaces the main CPU with mortar rendering the handheld useless.
