they can but its been more than a year without them blocking NDS flashcards
i get my 3ds 1 year ago, firmware was 7.x, they dont block them since then...

yeah they can block them but they stoped doing it... they also can prevent it permanently removing DS mode (something like sony did with the PS3 [talkin about ps2 compatibility])
