Homebrew What are the consequences of using an illegal SDK

I would like to try and port some software over to switch, I don't have 500$ hanging around. I wouldn't like to do this as a homebrew project since the game is very copyrighted. I want to show them that their game could potentially work on the switch but I wasn't able to get an SDK legally. If I were to go through with this. What potentially legal issues could arise. I'm kinda confused about it myself, I also took a huge test earlier and my brain is fried.

I believe you're using copyrighted assets to build your homebrew.
A good portion of original Xbox homebrew is build with the official XDK, which is the primary reason you don't see it distributed everywhere.

I'm not 100% certain on it but you're essentially distributing portions of copyrighted code.
A homebrew SDK is build from the ground up and is completely open source.
