Homebrew Question What are the chances of me being banned?

SciresM has mentioned before in Twitter comments (it's a reply and not a main post so it's hard to search) but he has mentioned before that there's only 3 things that Nintendo has banned for. Cheating/hacking online (any modification of games files/saves and then going online), Piracy (telemetry, installing piracy/homebrew nsp's, it's all piracy) and spoofing your ssl cert (this is how old pirate eshops worked. They would use a spoofed ssl cert so you could download games directly from Nintendo's cdn. Like how Piracy eshops on the WiiU worked).

There has not been any switch that is console banned without doing one of those three things.

1. he claimed that going online is a 100% ban, which according to your post is wrong. Hacking your switch and using cfw in itself seems not to be a bannable offense.
so basically you proved him wrong. (if those claims are correct)

2. There has not been any switch that is console banned without doing one of those three things. Is a huge claim that you can not prove in any way.
Anyone believes it to be the case because you/they couldnt prove otherwise but its still just an assumption based on the data you have, which again, does not have to reflect reality.

I am not saying that you are wrong. I for myself think that those three things are bannable offenses and you should be safe by not doing those things but thats my personal opinion. Personal opinions can be wrong though and objectivly looked at the situation, my point stays valid

To clarify - Telemetry of installing game updates unmodded switch to modded one is a bannable offense too?

I plan on keeping modded offline but might wanna play some of my carts with the latest updates. Otherwise my cfw switch will just be an emu machine

does cfw require being on latest version switch fw all the time to take advantage ? Ie are some hacked functionalities not gonna work unless you’re on latest version?

And haven't gotten banned for the entire year I used my V1 switch.
I even reinjected savegames into sysnand and synced them to my cloud no problemo.
Furthermore, switching between atmosphere and switchroot didn't cause any trouble either.

I suppose if you don't try to cheat Ninty is ok with it.
(Technically they could ban you just for having an atmosphere folder, so they must be ok with it existing...)

#Atmo and save tools are also the only way to move a save file from one account to another so...

It's honestly an uncertainty.

I've been using Atmosphere on my Switch for just about two and a half years now, and I've never been banned.

A few things I've done on my modded Switch include
  • Installing my own custom theme
  • Emulating older titles (mGBA, metroDS, PPSSPP, pEMU, RetroArch, Lakka)

    (I didn't install any .nsps for these emulators. I just have the .nros of them and stuffed them in the \switch\ folder, so I can launch them in the hbmenu via title-override. The latter is a different case. I launched Lakka through the bootloader in Hekate.)

  • Installing an nsp of the unofficial Switch port of Super Mario 64 (V7 by Team Atlas)

    (As far as I'm concerned, most of the people in the thread are saying that installing .nsps, preferably Switch games illegally acquired, is one of the main causes of a guaranteed ban, so this probably sparks a red flag. However, I've had this installed ever since the game's source code got leaked and before 3D All-Stars was even announced, but who knows what will happen...?)
Even after all that, I would still play my Switch games online, and nothing regarding online banishment would happen in the process, so really, it's an uncertainty to that degree. Although, I'm absolutely certain that illegally acquiring Switch games would guarantee a ban considering each copy has its own key.

I'm pretty sure that since the launch of atmosphere, there is people here that claims being banned only for launch atmosphere once just for testing or only for use homebrew. Maybe they are all liers but I doubt that...
