Actually, the KARL team broke 9.5 and noted how easy it would be to do 9.6 as well. There's lots of holes. So why Gateway hasn't released either emuNAND 9.6 or install exploit for user above 9.2 simply comes down to one thing:

When Gateway's bank account starts emptying out maybe they'll start fixing it. Otherwise, wait.
Even if they did achieve 9.4, it wouldn't really help them. Most new users are either using 9.5+ or 9.0 systems will be hard to find by the time they do.
And yes, limited editions seem to be coming with 9.4 and even some with 9.5. So try to avoid LE 3DS systems. Because LE editions tend to manufactured more recently than main batches, they go for the newest firmware.
Otherwise, I understand OP's intent about this thread. It is frustrating that they haven't released emuNAND 9.6, yet alone allowed for 9.3+ systems to install. Lots of people (including me) who are simply waiting to buy so they can transfer. Need we mention the eShop access debacle...
Sadly, Gateway has this reputation. Promise you the world... and then update blocks it. The Sky3DS kind of avoids this, but even then, headers are hard to get unless you own Powersaves. Nor can you dump ROMs or backup sysNAND.
This is why the DSTwoPlus is tempting, because of their update reputation. But it seems like Nintendo is winning this fight as more manufacturers are hitting the wall of update hell.
Really? My opinion is that Nintendo is hurting itself. They're so worried about "piracy" that they neglect more advanced users from backup utilities. Most 3DS users are kids. We're the oldskoolers who love games. In fact, the best thing I've noticed about having a Sky3DS is simply being able to test play a lot of games.
I might actually buy Pac-Man Galaga for online play. I really want Pac-Man CE DX + for 3DS, but no one listens. I might actually guy NES Remix after having played it. This helps me to actually choose.
The weirdest game I've tried so far that everyone recommends is Persona Q. Oh muh gawd... this game has so much sexual innuendo I actually blushed. The game itself isn't all that great. But now I know.
I don't get that from Nintendo. Even with Demo plays. Demos are so stripped down and useless they're not really worth it.
So many games with high price tags that could actually do more in sales if it wasn't for greed.
And the worst is the wallpapers. They're actually tempting kids to steal their parent's credit card for wallpapers. WTF Nintendo? Really? For $40 a game, we should get the game, some neat extras AND free stuff like wallpapers.
Instead, they shut down Nintendo Club.
Brilliant folks. Just brilliant.
And don't blame the hackers or cheaters. That's just projection. There will always be people like that. You have to always keep your eye on the prize: kids. They're lucky to even have a 3DS and a game or two. Give them a reason to care. Bring back the magic. Throw free digital stuff out for free. Break the mold and show the industry why it is heading down the wrong path.

Oh, and paying for old NES and GB games for virtual console? Theft. Go get a PC. Download emulators and enjoy them for FREE. You don't even need a 3DS to do it. All of that should be for free. But no, they're charging us for it. That's sickening.
Just sick of this right now. At least my Sky3DS works. Go back to playing AND ENJOYING GAMES again. Luigi's Mansion is addictive. And I finally turned the announcer off on Ridge Racer. My gawd, someone shoot her next time. So annoying...

Absolutely correct, Nintendo need to stop charging up the ass for old games that we already bought, this isn't going to help innovate the game industry although they do try with 3DS and Wii U's uniqueness
Gateway have honestly have given me a bit more fun with my 3ds so I gotta give them a lot of credit, I can also get VC games now for free which is good, Nintendo need to get back to planet URF...sorry i mean earth
